Terms of Sale and Use

These terms cover Simply GIFs and this website. "We," "us" and "Cyber Cat" mean Cyber Cat LLC, a New Mexico limited liability company based in Albuquerque, New Mexico. By buying or using Simply GIFs, you agree to these terms.
Who you're buying from
Our order process is run by our online reseller Paddle.com, who is the Merchant of Record for all our orders. Paddle handles checkout, payment, sales tax, receipts and refunds, and can help with any payment or refund question. You can also email us and we'll sort it out with Paddle. When you buy, you're also agreeing to Paddle's Buyer Terms (www.paddle.com/legal/buyer-terms).
Your license
When you buy Simply GIFs, we give you a personal, non-exclusive, non-transferable license to install and use it:
- 1 Mac license ($5): on one Mac you own or control.
- 3 Mac license ($10): on up to three Macs you own or control.
The license covers every 1.x version of Simply GIFs. It's a one-time purchase, with no subscription. You can use Simply GIFs for personal or work projects.
Please don't resell, share, rent or publish your license or download, and don't try to get around how the app is licensed. We still own Simply GIFs and its code. You're buying a license to use it, not the software itself.
Your GIFs are yours
Anything you record and every GIF you make belongs to you. We never see it. Only record things you have the right to record.

30 days, no questions asked. See our Refund Policy.
Updates and support
1.x updates are free while we make them. We can't promise a set schedule, or that we'll support every future macOS version. Support is by email at hello@cybercatlabs.com, and a real person answers.
Open-source software
Simply GIFs includes open-source components under their own licenses. They're listed in THIRD-PARTY-NOTICES.md, which comes in your download and inside the app bundle. Those licenses apply to those components.
No warranty
SIMPLY GIFS AND THIS WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. We work hard on it, but we can't promise it'll be error-free or work with every setup.
Limitation of liability
To the fullest extent the law allows, Cyber Cat LLC isn't liable for any indirect, incidental, special or consequential damages, or for lost data or profits, arising from your use of Simply GIFs or this website. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR SIMPLY GIFS. Some places don't allow these limits, so they may not all apply to you. Nothing here takes away rights you have under consumer law that can't be waived.
Ending your license
If you break these terms, your license can end. You can stop using Simply GIFs at any time. If you want your money back within 30 days, use the Refund Policy.
Sections on ownership, no warranty, limitation of liability and governing law continue after your license ends.
Governing law
These terms are governed by the laws of the State of New Mexico, USA, except where your local consumer law says otherwise.
Changes
We may update these terms. When we do, we'll change the date at the top. The terms in place when you bought still cover that purchase.
